TRUST
A Trust is a legal entity with rights, similar to a human person or corporation. Party A, (Grantor) gives party B (trustee) the possession and rights to manage property or other assets for the benefit of party C (beneficiary).
What you in essence create is another “person” that does exactly what you want that person to do with regard to your estate (all your possessions, tangible and intangible). Really let that sink in to realize the power of a Trust.
Trusts provide legal protection, Identity protection, protection of property, financial protection, and protection of certain rights. While many Types of Trusts exist, one needs to have a firm understanding of exactly what one wants: more rights protection, more asset protection; who is to benefit: Heirs, the Trustor, both? We are experts at getting answers and asking specific questions for a surgical structuring of your Trust instrument, and every effort is put forth to maximize your control while minimizing space to allow interloper intrusion into your estate affairs.
How a Trust can protect your rights: The right for you to decide (not the state) who gets what is protected; the information on what you "possess" can be hidden from the public, steering you clear of avoidable assessments; your digital footprint can be greatly reduced, if not virtually eliminated.
WILLS
A Will, also called a "Last Will and Testament," is a document that outlines how a principle wants to distribute assets and wealth after passing. If there are heirs, a Will also allows principle to designate which heir will care for them, and any assets or money in the estate can be directed to heirs as well. A Will however, is not the end-all-be-all to your Estate Plan. It is much less effective than a Trust in that:
A Will must go through a court process called a “probate” which makes it subject to the courts changing it or actually denying it altogether. Instructions are not guaranteed to play out as the principle had planned when a Will goes through a judge for execution.
A Will is also subject to challenge by almost any family member who can show a plausible interest in the property or funds distribution.
However, a Will is a very good segue bridge until a Trust is formed for the same purpose. A Will can be an excellent preparative process to organize assets and monetary benefits for distribution, so it should not immediately be overlooked.
A Living Will, also called an “Advance Healthcare Directive (AHD)” is different from a Will in that:
it is used to give detailed instructions to health care providers in the event that the principle can no longer make decisions for themselves.
This eliminates others, even family members, from having to make hard decisions or fighting over what to do in the event the principle becomes incapacitated and unable to make decisions in their best interest. A Living Will rarely, if ever, deals directly with financial or asset allocation.
POWER of ATTORNEY
There is a secret buried in the processes of many Power of Attorney (P.O.A) appointments. That secret is that you can literally cherry pick one, or a combination of P.O.A elements for specific people to do specific things, and access can be granted to one, but not the other. You can even combine the use of P.O.A with Trusts and Wills. You want party "A" to cash your checks for you but not have access to your bank account; no problem, party "B" can be the one to have bank access and not Party "A" who is only allowed to cash your checks. The same can be done for Wills, Trusts, general contracts, etc. P.O.A appears to be a simple document but can actually help with estate management while you prepare a more codified structure, so they are not to be overlooked.
There are several types of Power of Attorney. The following are some examples:
1. Non-Durable Power of Attorney: effective until principle becomes incapacitated or passes
2. Durable Power of Attorney: effective immediately and AFTER principle becomes incapacitated
NOTE: most P.O.A can be either durable or non-durable
3. General Power of Attorney: gives very broad range of control to agent and can be Non-durable or durable
4. Limited (Special) Power of Attorney: Agent is given only certain specified powers outlined in P.O.A document

In either case, you get a well structured instrument and the benefits of Trust training via phone or video media with our many Trust videos online. Please note, we do not manage financial matters of your Trust outside of suggestions of asset management with regard to lawful investments from our experience.
